1. Acceptance of Terms

By using Nenzy.ai, whether as a Job Seeker, Recruiter, Employer, or Partner, you agree to comply with and be legally bound by these Terms. If you do not agree, you may not use our platform.

2. Services Overview

Nenzy.ai is an AI-powered hiring platform that offers:

• Job automation and application submissions
• AI-conducted interviews (text, voice, or video)
• Real-time evaluations and scoring
• Resume/profile sharing with employers
• Listing in the Nenzy Talent Market
• Hiring tools and dashboards for recruiters and partners

3. User Account Responsibilities

A. Job Seekers

• Must be 18+ years old and provide truthful information
• Are responsible for maintaining confidentiality of login credentials
• Consent to sharing their resume, interview, profile photo, and evaluations with employers and hiring platforms

B. Employers & Recruiters

• Must be verified and legally authorized to hire on behalf of their organization
• Agree not to misuse, resell, or share candidate data outside of legitimate hiring processes
• Are responsible for fair and ethical hiring practices

4. Candidate Data Usage

By using Nenzy.ai, you agree that:

• Your profile, resume, interview content, and photo may be shared with employers, featured in the Nenzy Talent Market, or listed on integrated job/hiring platforms.
• Your data may be used for AI model improvement, analytics, and platform optimization in anonymized form.
• Nenzy is not liable for third-party misuse once your profile has been shared externally with your consent.

5. Payment, Subscription & Refund Policy

5.1 Subscription-Based Services

Nenzy.ai offers both free and premium features. Subscriptions may include:

• Access to AI interviews
• Resume sharing features
• Employer dashboards
• Priority visibility in Nenzy Talent Market

All subscription services are prepaid and activated only after successful payment.

5.2 No Refund Policy

Nenzy.ai follows a strict no-refund policy. Refunds will NOT be issued for:

• Unused or partially used subscription time
• Non-selection by employers
• User dissatisfaction with interview outcomes
• Duplicate upgrades or plan changes after payment

Refunds will be considered only if:

• There is a verified billing error (e.g., duplicate charge)
• A technical failure on Nenzy’s end prevents service delivery for over 48 hours

Requests must be submitted within 3 days of transaction to hello@nenzy.ai.

5.3 Recurring Billing

• All subscriptions auto-renew at the end of the billing cycle unless canceled prior.
• You are responsible for managing your subscription from the dashboard.
• Nenzy is not liable for refund requests submitted after auto-renewal.

5.4 Payment Failures

If your payment is unsuccessful:

• Your account may be suspended or downgraded
• Access to features (interviews, Talent Market) will be paused
• Missed opportunities due to non-payment are not Nenzy’s responsibility

5.5 Chargebacks & Disputes

If you initiate a chargeback:

• Your account will be permanently blocked
• Nenzy may pursue legal recovery or assign the dispute to a collections agency
• You may be liable for damages, transaction fees, and legal costs

By using Nenzy.ai, you agree not to file false chargebacks or disputes with your bank or card provider.

6. Interview Consent

All interviews conducted on Nenzy.ai may be:

• Recorded (text, audio, or video)
• Stored for future evaluation and job matching
• Shared with verified employers and hiring teams

By participating, you give explicit consent to these uses.

7. Platform Limitations

Nenzy.ai does not:

• Guarantee hiring or job placement
• Take responsibility for employer hiring decisions
• Offer employment directly to users

The platform is provided “as-is” with no warranty of results.

8. Intellectual Property

Nenzy.ai and its content (UI, codebase, platform logic, AI workflows, and brand assets) are owned exclusively by NenzyAI Inc and DesiBoy Technologies Pvt. Ltd.
You may not:

• Copy, clone, or modify platform features
• Misuse any part of Nenzy’s brand or system for competing products

9. Termination

Nenzy may terminate access or subscriptions at any time if:

• You breach these Terms
• Fraudulent activity is detected
• Repeated failed payments or chargebacks occur
• Partner agreements are violated

No refunds will be issued upon termination for misconduct.

10. Limitation of Liability

Nenzy.ai is not liable for:

• Employment decisions or rejections
• Missed opportunities due to user error
• Platform downtime from third-party infrastructure issues
• Loss of data due to user actions

Our total liability is limited to the amount you’ve paid in the last 90 days.

10A. Data Loss and Recovery

Nenzy.ai uses best practices and secure infrastructure to safeguard your data. However, by using our platform, you acknowledge and agree that:

• Nenzy.ai shall not be held liable for any loss, corruption, or deletion of data (including resumes, interview recordings, messages, profiles, evaluations, or documents) caused by:
  1. Technical malfunction, bugs, or downtime
  2. Server failure or third-party service disruption (e.g., AWS, OpenAI, Stripe)
  3. Cyber-attacks or unauthorized access beyond Nenzy’s control
  4. Accidental deletion by the user or misuse of the platform
• While Nenzy performs routine backups, data recovery is not guaranteed in case of severe loss or corruption.
• It is your responsibility to:
  1. Keep local backups of important documents (e.g., resumes, feedback reports)
  2. Use strong, unique passwords and protect your login credentials
  3. Regularly update your profile and stored information

Nenzy.ai is not responsible for:

• Job losses, missed interviews, or business impact due to data loss
• Inability to access previously stored candidate or recruiter information
• Loss of access due to forgotten credentials or account termination

If you experience data issues, contact us at hello@nenzy.ai, and we’ll attempt recovery to the best of our ability.

11. User Content and Responsibility

Users are solely responsible for the content they upload or submit, including resumes, photos, interview responses, and messages. Nenzy.ai disclaims all liability arising from any third-party claims related to user content, including intellectual property infringement, defamation, or misinformation.

12. Third-Party Services

Nenzy.ai may integrate or rely on third-party services and APIs (such as OpenAI, payment gateways, cloud hosting). We do not guarantee the availability, accuracy, or performance of these third parties and disclaim liability for any interruptions or changes they make.

13. Privacy Policy

Please review our Privacy Policy for detailed information on how we collect, use, and protect your personal data.

14. Prohibited Uses

You agree not to use Nenzy.ai to:

• Violate any applicable laws or regulations
• Harass, discriminate against, or harm other users
• Attempt unauthorized access to other accounts or systems
• Engage in fraudulent, malicious, or harmful activity

15. Indemnification

You agree to indemnify, defend, and hold harmless NenzyAI Inc, DesiBoy Technologies Pvt. Ltd., their affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses arising out of or in connection with your breach of these Terms or your use of the platform.

16. Modification of Services

Nenzy.ai reserves the right to modify, suspend, or discontinue any aspect of the services at any time without prior notice.

17. Force Majeure

Nenzy.ai shall not be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, internet outages, or government restrictions.

18. Entire Agreement and Severability

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nenzy.ai. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be settled in the courts of Kent County, Delaware.

20. Service Level Agreement (SLA)

A. Uptime

Nenzy.ai strives for 99.5% monthly uptime, excluding:

• Scheduled maintenance
• Force majeure events
• Downtime due to external service providers (e.g., AWS, Stripe)

B. Support

• Email support: hello@nenzy.ai
• Business Hours: Mon–Fri, 9 AM–7 PM IST
• Critical Issues: Response within 12 hours
• Non-critical: Within 24 hours

21. Partnership Terms

A. Agency/Recruiter Access

Nenzy may offer special access to verified recruitment firms, including:

• Dashboard for managing listings
• Candidate filtering and outreach
• Limited access to interviews and reports

All use must be for legitimate recruitment only.

B. Commission Structure

Recruitment partners may be eligible for:

• Commissions on successful hires
• Referral bonuses for candidate subscriptions
• Payouts via monthly or quarterly cycles (as per separate signed agreement)

C. Code of Conduct

Recruitment partners agree not to:

• Resell candidate data
• Misrepresent Nenzy.ai in front of clients
• Compete by copying Nenzy’s process or branding

Violations result in immediate ban and legal pursuit.

22. Confidentiality

Any shared documents, analytics, code access, or API keys must be kept strictly confidential and used only for the agreed purpose.
